1. Acceptance of Terms
By creating a FlexotiumPOS account or using any part of the service, you agree to these Terms of Service. If you are using FlexotiumPOS on behalf of a business, you represent that you have authority to bind that business to these terms.
2. Description of Service
FlexotiumPOS is a cloud-based point-of-sale and business operations platform providing checkout, inventory management, purchasing, AI-powered forecasting, workflow automation, and related services. The platform is provided on a subscription basis.
3. Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. After the trial period, continued access requires a paid subscription. We will notify you before your trial ends.
4. Subscriptions and Payment
Subscriptions are billed per seat per role (Cashier, Accountant, Manager, Owner). You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
5. Acceptable Use
You may use FlexotiumPOS only for lawful business purposes. You may not use the service to process fraudulent transactions, violate any applicable laws or regulations, attempt to reverse-engineer the platform, or interfere with other merchants' use of the service.
6. Data Ownership
You retain full ownership of all business data you input into FlexotiumPOS (transactions, products, customers, etc.). We do not claim ownership of your data. You can export a complete copy of your data at any time and request deletion upon account termination.
7. AI Features
AI-powered features (forecasting, copilot, automation) are provided as operational tools. AI outputs are advisory and should be reviewed by qualified personnel before acting on them. We do not guarantee the accuracy of AI forecasts or recommendations.
8. Uptime and Service Levels
We aim for 99.5% monthly uptime for core POS functionality. The offline-safe mode ensures checkout continues during connectivity disruptions. Planned maintenance will be communicated in advance. We are not liable for outages beyond our reasonable control.
9. Limitation of Liability
To the maximum extent permitted by law, FlexotiumPOS liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or business interruption.
10. Changes to Terms
We may update these terms with 30 days notice for material changes. Continued use of the service after the effective date constitutes acceptance. If you do not agree to updated terms, you may cancel your subscription before the effective date.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales. If you are a consumer, you retain the benefit of any mandatory consumer protection laws in your jurisdiction.
